By accessing or using Pilates.com.au, creating an account, claiming or creating a listing, purchasing a membership, submitting an enquiry, selling a product, listing equipment, advertising, uploading content or making a purchase, you agree to these Terms.
If you do not agree to these Terms, you must not use the website or platform.
1. Definitions
In these Terms: Platform means pilates.com.au and all related directory, marketplace, membership, payment, communication, listing, advertising, content and account features.
User means any person who accesses or uses the Platform.
Member means a person or business that creates an account, purchases a membership, claims a listing or accesses member-only features.
Business Member means a studio, instructor, education provider, equipment supplier, advertiser, professional, service provider or other business using the Platform.
Seller means a person or business that lists or sells products, equipment, courses, services or other items through or via the Platform.
Buyer means a person who purchases, enquires about or interacts with a Seller through the Platform.
Listing means a business profile, studio profile, instructor profile, product listing, event listing, job listing, equipment listing, course listing, service listing or other published profile or advertisement.
Content means text, images, logos, videos, descriptions, reviews, ratings, comments, product information, course material, downloadable files, directory data and other material submitted to or published on the Platform.
Third-Party Provider means any independent studio, instructor, seller, supplier, education provider, service provider, advertiser, marketplace vendor or business listed on the Platform.

You must be at least 18 years old to create an account, purchase a membership, list a business, sell goods or services, submit a business enquiry or use paid features on the Platform.
You agree to provide accurate, complete and current information when creating an account, listing a business, making a purchase, submitting an enquiry or using the Platform.
You are responsible for:
- maintaining the confidentiality of your login details;
- all activity that occurs under your account;
- keeping your account details up to date;
- ensuring that any information you submit is accurate and lawful;
- notifying us immediately if you suspect unauthorised account access.
We may refuse, suspend, restrict or terminate an account if we reasonably believe there has been a breach of these Terms, misuse of the Platform, suspicious activity, fraud, non-payment, misleading conduct, unlawful activity or other behaviour that may harm the Platform or its users.

Pilates.com.au operates as an online Pilates directory, membership platform, advertising platform, marketplace and information resource.
The Platform may allow users to:
- search for Pilates studios, instructors, training providers, equipment suppliers and related services;
- create or claim business listings;
- purchase paid listing memberships;
- advertise businesses, services, courses, products or events;
- submit enquiries to listed businesses;
- list or purchase goods and services;
- access digital resources, videos or courses;
- post or view reviews, ratings or testimonials;
- list jobs, workshops, retreats, courses, equipment or other Pilates-related opportunities.
Unless expressly stated otherwise, Pilates.com.au is a platform provider and directory operator. We are not the seller, manufacturer, trainer, instructor, studio, therapist, health provider, delivery provider or organiser of third-party goods or services.

Pilates.com.au may offer free and paid membership tiers, listing packages, advertising packages, promotional placements, digital subscriptions, seller access and other paid services.
Membership tiers may include, but are not limited to:
- Basic Listing;
- Contact Listing;
- Enhanced Listing;
- Premium Listing;
- Featured Listing;
- Sponsored Listing;
- Seller Account;
- Advertiser Account;
- other plans or packages published on the Platform.
The features included in each membership or listing tier will be described at the time of purchase or registration.
Features may include, depending on the plan:
- business name;
- category;
- location and map display;
- phone number;
- email contact;
- website link;
- booking link;
- images;
- videos;
- business description;
- search visibility;
- featured placement;
- testimonials;
- reviews;
- instructor profiles;
- lead capture tools;
- SEO profile features;
- analytics;
- dashboard access;
- seller or advertising tools.
We may change, add, remove, rename or restructure membership tiers and listing features from time to time. Where a material change affects a paid membership, we will take reasonable steps to notify affected members.
Back to contents5. Billing, Payments and Auto-Renewal
Unless otherwise stated, prices are in Australian dollars and may include GST where applicable.
Paid memberships, listing packages, subscriptions, advertising placements and digital services may be billed monthly, annually, once-off or on another basis shown at checkout.
By purchasing a recurring subscription, you authorise us or our payment processor to charge your nominated payment method on a recurring basis until you cancel.
You are responsible for ensuring that your payment method remains valid and has sufficient funds.
If a payment fails, we may:
- retry the payment;
- notify you of the failed payment;
- suspend or downgrade paid features;
- hide or reduce the visibility of your listing;
- restrict dashboard access;
- cancel the subscription;
- recover outstanding amounts where permitted by law.
We may use third-party payment processors, including Stripe, PayPal or other secure providers. We do not store full credit card details on our own servers unless expressly stated.
Back to contents6. Subscription Cancellation
You may cancel a subscription through your account dashboard where available, or by contacting us.
Unless otherwise stated:
- cancellation stops future billing;
- paid access usually continues until the end of the current billing period;
- cancellation does not automatically entitle you to a refund for the unused part of a billing period;
- after cancellation, your listing may be downgraded, hidden, archived or converted to a free/basic listing.
Any free trial, introductory offer, promotional period, cancellation right or cooling-off period will be stated at the time of purchase or registration.
Nothing in these Terms limits your rights under the Australian Consumer Law.

Refunds are governed by our Refund Policy, which forms part of these Terms.
Unless required by law or stated in the Refund Policy, refunds are not generally provided for:
- change of mind;
- unused membership time;
- failure to use a subscription;
- failure to complete a profile;
- failure to upload images or content;
- dissatisfaction with the number of enquiries, leads, bookings, clicks or sales received;
- expected SEO rankings not being achieved;
- cancellation part-way through a billing period;
- digital products after access has been provided;
- advertising placements after publication or campaign commencement.
If you believe you have been charged incorrectly, please contact us promptly.

Business Members are responsible for ensuring that all listing information is accurate, current, lawful, complete and not misleading.
This includes, but is not limited to:
- business name;
- address;
- service area;
- phone number;
- email address;
- website;
- booking links;
- opening hours;
- pricing;
- qualifications;
- certifications;
- affiliations;
- services;
- class types;
- specialties;
- health, rehabilitation, clinical or therapeutic claims;
- images;
- videos;
- logos;
- testimonials;
- offers;
- product information;
- delivery terms;
- cancellation terms.
We may edit, refuse, suspend, downgrade, unpublish or remove any listing that we reasonably believe is inaccurate, misleading, duplicated, incomplete, unlawful, inappropriate, spam-related, unsafe, in breach of these Terms or unsuitable for the Platform.
Paid listings, premium listings, featured placements, sponsored listings, badges or verification labels do not constitute professional accreditation, endorsement, clinical approval or certification by Pilates.com.au unless expressly stated.

A business owner or authorised representative may request to claim an existing listing.
We may require verification before approving a claim, including:
- email verification;
- phone verification;
- website domain verification;
- business registration information;
- ABN or company details;
- proof of business ownership;
- proof of authority to act on behalf of the business;
- identity verification;
- other information reasonably required.
We may approve, reject, delay or revoke listing claims at our discretion if ownership, authority, identity or accuracy cannot be verified.
If a listing is claimed by the wrong person or by an unauthorised representative, we may suspend the account, reverse the claim, remove edits or take other corrective action.
Back to contents10. Featured Listings, Sponsored Placements and Advertising
Pilates.com.au may offer paid advertising and promotional options, including:
- featured listings;
- premium listings;
- homepage placements;
- category placements;
- location placements;
- map priority placements;
- sponsored articles;
- banner advertisements;
- newsletter features;
- badge promotions;
- “top studio” or similar promotional packages;
- event promotion;
- job promotion;
- equipment or product promotion.
Sponsored or featured placement may affect the order, prominence or visibility of listings.
Where appropriate, paid placements may be identified as “featured”, “sponsored”, “promoted”, “premium” or similar.
Advertising and featured placement fees are charged for placement, exposure or access to promotional inventory. We do not guarantee any specific number of views, clicks, enquiries, bookings, sales, leads, customers, search rankings, revenue or business outcomes.
We may refuse or remove advertisements that we reasonably consider misleading, unlawful, unsafe, offensive, inappropriate, low quality, infringing, non-compliant or unsuitable for the Platform.

Pilates.com.au provides directory, marketplace, membership, advertising, promotional and lead-generation services.
We do not guarantee that any listing, membership, advertisement, featured placement, badge, review, lead-generation service, article, SEO page, search result, marketplace listing or promotional campaign will generate:
- enquiries;
- bookings;
- phone calls;
- website visits;
- sales;
- students;
- clients;
- rankings;
- traffic;
- income;
- reviews;
- business growth;
- commercial results.
Search visibility, listing order, website traffic, user behaviour, search engine results and market conditions may vary over time.
You are responsible for the quality, accuracy and appeal of your own listing, offer, service, pricing, follow-up, customer service and business operations.

Users may submit enquiries, booking requests, quote requests, contact forms, product enquiries, class enquiries, lead forms or other messages through the Platform.
If a user submits an enquiry through a listing or lead form, we may share the information provided with the relevant studio, instructor, seller, education provider, equipment supplier, service provider or business so they can respond.
Enquiry information may include:
- name;
- email address;
- phone number;
- suburb or location;
- enquiry message;
- product or service interest;
- preferred booking time;
- health, movement or fitness goals if voluntarily provided;
- other information submitted by the user.
Businesses receiving leads are responsible for following up promptly, professionally and lawfully.
We do not guarantee that any lead will be genuine, exclusive, current, accurate, contactable or likely to become a paying customer.
Where a lead is clearly duplicated, fraudulent, spam, technically invalid or generated by system error, we may offer a replacement lead, credit or other remedy at our discretion.

Pilates.com.au may allow third-party sellers, suppliers, studios, instructors, education providers and other businesses to list, advertise or sell goods or services through or via the Platform.
Unless expressly stated otherwise:
- Pilates.com.au is not the seller of third-party goods;
- Pilates.com.au is not the supplier of third-party services;
- Pilates.com.au is not the manufacturer of third-party products;
- Pilates.com.au is not responsible for third-party fulfilment;
- Pilates.com.au is not responsible for third-party delivery;
- Pilates.com.au is not responsible for third-party warranties;
- Pilates.com.au is not responsible for third-party refunds or returns;
- the contract for third-party goods or services is between the buyer and the relevant seller or provider.
Third-party sellers are responsible for:
- product and service descriptions;
- pricing;
- stock availability;
- order fulfilment;
- delivery;
- pickup arrangements;
- returns;
- refunds;
- repairs;
- replacements;
- warranties;
- customer service;
- safety;
- legal compliance;
- Australian Consumer Law obligations.
Buyers should contact the seller directly for product questions, delivery issues, warranty claims, returns, refunds, exchanges, missing parts, damaged goods, service disputes or other transaction issues.
Pilates.com.au may assist with communication or investigate platform misuse, but we do not guarantee resolution of disputes between buyers and sellers.

Pilates.com.au may allow used Pilates equipment, second-hand goods or private seller listings to be displayed on the Platform.
Used equipment may include, but is not limited to:
- reformers;
- trapeze tables;
- Wunda Chairs;
- barrels;
- springs;
- frames;
- mats;
- accessories;
- studio equipment;
- spare parts;
- other second-hand Pilates-related items.
Unless expressly stated otherwise, Pilates.com.au does not inspect, test, service, certify, verify, warrant or guarantee the condition, safety, authenticity, ownership, completeness, suitability, compatibility, delivery, availability or legal status of used equipment or second-hand goods.
Buyers must make their own enquiries before purchasing, including:
- inspecting the item where possible;
- confirming condition;
- confirming age, brand and model;
- checking springs, frames, upholstery, ropes, pulleys and moving parts;
- checking prior repairs or modifications;
- confirming included and missing parts;
- confirming measurements and compatibility;
- confirming pickup or delivery arrangements;
- confirming ownership;
- confirming payment terms;
- obtaining receipts or written agreements.
Pilates.com.au is not responsible for loss, injury, damage, defects, missing parts, delivery issues, payment disputes or suitability issues arising from used equipment or private seller transactions, except where required by law.

Sellers must ensure that all goods and services listed on Pilates.com.au are accurately described, lawfully supplied, safe, fit for any purpose represented, and compliant with applicable laws.
Sellers must not list:
- stolen goods;
- counterfeit goods;
- unsafe goods;
- recalled goods;
- prohibited goods;
- misleading products;
- products they do not own or have authority to sell;
- products with false brand or model claims;
- services they are not qualified or authorised to provide.
Sellers must respond to buyer enquiries, delivery issues, refund requests, warranty claims and disputes in a timely and professional manner.
Sellers must not misuse buyer information, add buyers to unrelated mailing lists, contact buyers for unrelated marketing without consent, disclose buyer information to unauthorised parties or use personal information for purposes unrelated to the relevant transaction.
We may suspend or remove a Seller if we reasonably believe the Seller has breached these Terms, misled buyers, failed to fulfil orders, breached privacy obligations, listed unsafe goods or acted in a way that may harm users or the Platform.

Pilates.com.au may list, promote, sell or provide access to courses, workshops, events, masterclasses, retreats, training programs, webinars, videos or digital education.
Some courses or events may be provided by Pilates.com.au. Others may be provided by third-party providers.
Unless expressly stated otherwise, third-party course providers, event organisers and training providers are responsible for:
- course descriptions;
- dates and times;
- venues;
- instructors;
- cancellations;
- refunds;
- transfers;
- certificates;
- attendance requirements;
- course outcomes;
- professional recognition;
- accreditation claims;
- delivery quality;
- student support.
Pilates.com.au does not guarantee that a third-party course, workshop or event will meet your expectations, qualify you for employment, provide professional accreditation, satisfy insurance requirements or be accepted by any third-party organisation unless expressly stated by the relevant provider.
You should review the provider’s own terms, refund policy, certification claims and course details before purchasing or enrolling.

The Platform may allow users to submit reviews, ratings, comments or testimonials.
Reviews must be genuine, lawful, accurate and based on a real experience.
You must not post:
- fake reviews;
- misleading reviews;
- defamatory content;
- offensive content;
- spam;
- competitor attacks;
- reviews on behalf of another person without permission;
- reviews containing private or confidential information;
- incentivised reviews without proper disclosure;
- content that breaches the rights of another person.
Businesses must not:
- review themselves;
- create fake customer accounts;
- pay for fake reviews;
- pressure customers to leave false reviews;
- suppress genuine negative feedback improperly;
- post negative reviews about competitors;
- manipulate ratings or review systems.
We may moderate, edit, reject, hide or remove reviews at our discretion.
Publication of a review does not mean we endorse the review or verify every statement in it.
Businesses may be given the ability to respond to reviews, subject to our platform rules.

Pilates.com.au may display badges, labels, verification marks, featured status, premium status, awards or promotional designations.
Examples may include:
- Verified Business;
- Premium Listing;
- Featured Studio;
- Founding Member;
- Education Provider;
- Equipment Supplier;
- Back Pain Specialist Listing;
- Top Rated;
- Best for Back Pain;
- Top Studio in [Location];
- other badges or promotional labels.
Unless expressly stated otherwise, badges are directory or promotional indicators only. They do not necessarily mean that Pilates.com.au has audited, certified, clinically assessed, professionally accredited or endorsed the business.
Where a badge requires verification, we may request evidence and may remove the badge if the evidence is insufficient, outdated, misleading or no longer valid.
Businesses must not use Pilates.com.au badges, awards, logos or verification marks outside the Platform unless we have granted written permission or a badge licence.

Pilates.com.au provides general information about Pilates, movement, fitness, wellness, education, equipment and related services.
The Platform does not provide medical advice, physiotherapy advice, diagnosis, treatment, rehabilitation advice or personalised health advice.
Any information about Pilates, back pain, injury, pregnancy, rehabilitation, posture, exercise, movement, equipment or wellness is general information only and may not be suitable for your individual circumstances.
You should seek advice from an appropriately qualified health professional before starting any exercise program, using equipment, attending a class, purchasing a course or following any exercise information, particularly if you have:
- pain;
- injury;
- back pain;
- neck pain;
- pregnancy;
- recent surgery;
- medical conditions;
- physical limitations;
- neurological conditions;
- osteoporosis;
- balance issues;
- any concern about your ability to exercise safely.
Listed studios, instructors, therapists, education providers and sellers are independent providers. Pilates.com.au is not responsible for the advice, services, treatments, classes, programs, outcomes, conduct or representations of third-party providers.
You participate in exercise and movement activities at your own risk, subject to your rights under Australian Consumer Law and other applicable laws.

You may be able to upload, submit or publish content, including:
- listing descriptions;
- business information;
- images;
- logos;
- videos;
- reviews;
- comments;
- product descriptions;
- event descriptions;
- course descriptions;
- testimonials;
- advertisements;
- downloadable files;
- other content.
You warrant that:
- you own the content or have permission to use it;
- the content is accurate and not misleading;
- the content does not infringe copyright, trademark, privacy, confidentiality, moral rights or other rights;
- the content does not contain unlawful, offensive, defamatory, discriminatory, unsafe, harmful or misleading material;
- you have obtained any required consent from people shown or identified in images, videos, testimonials or other materials.
You grant Pilates.com.au a worldwide, royalty-free, non-exclusive licence to use, reproduce, display, publish, edit, adapt, promote, distribute and communicate your submitted content for the purpose of operating, promoting and improving the Platform.
This licence continues for as long as reasonably required to operate the Platform, maintain records, promote listings, manage disputes, comply with legal obligations or preserve backups.
We may remove or modify user-generated content at our discretion.

All intellectual property rights in the Platform, including website design, directory structure, databases, content, text, graphics, logos, software, layouts, videos, course materials, branding, trade marks and other materials, are owned by us or our licensors unless otherwise stated.
You must not copy, reproduce, scrape, harvest, download, republish, sell, distribute, modify, reverse engineer, frame, mirror or exploit any part of the Platform without our written permission.
You must not use automated tools, bots, crawlers, scrapers, data-mining tools, AI training tools or similar technologies to extract listings, user data, pricing, reviews, contact details, directory data or other content from the Platform without our written permission.
Nothing in these Terms transfers ownership of our intellectual property to you.
Business Members and Sellers retain ownership of content they upload, subject to the licence granted to us under these Terms.

You must not use the Platform to:
- breach any law;
- mislead or deceive users;
- post false, inaccurate or incomplete information;
- impersonate another person or business;
- claim a listing without authority;
- upload infringing content;
- misuse reviews or ratings;
- harass, abuse, threaten or intimidate others;
- publish defamatory, offensive, discriminatory or unlawful material;
- distribute spam or malware;
- attempt to gain unauthorised access to the Platform;
- interfere with site security;
- scrape or harvest data;
- copy or resell directory information;
- manipulate search results or rankings;
- list unsafe, stolen, counterfeit, unlawful or prohibited goods;
- make false clinical, rehabilitation, certification or qualification claims;
- misuse buyer, seller, member or enquiry information;
- use the Platform in a way that may damage our reputation or operations.
We may suspend or terminate access where we reasonably believe prohibited conduct has occurred.

Your use of the Platform is also governed by our Privacy Policy.
By using the Platform, you agree that we may collect, use, store and disclose personal information in accordance with our Privacy Policy.
If you submit an enquiry, booking request, lead form, product enquiry or message through the Platform, you acknowledge that your details may be shared with the relevant listed business, seller, instructor, studio, education provider or supplier so they can respond.
Business Members and Sellers must handle personal information received through the Platform lawfully and only for the purpose for which it was provided.

The Platform may contain links to third-party websites, booking systems, payment platforms, social media pages, course platforms, seller websites, delivery providers or other external services.
Third-party sites and services are not controlled by Pilates.com.au.
We are not responsible for:
- third-party website content;
- third-party availability;
- third-party security;
- third-party privacy practices;
- third-party terms;
- third-party pricing;
- third-party booking systems;
- third-party service delivery;
- third-party products;
- third-party errors or omissions.
You access third-party websites and services at your own risk.

We aim to keep the Platform available and functioning, but we do not guarantee uninterrupted, secure or error-free operation.
We may modify, suspend, discontinue, update or restrict any part of the Platform at any time, including features, listings, categories, membership tiers, search functions, pricing, advertising inventory, marketplace functions and user dashboards.
We may correct errors, update content, change layouts, improve functionality or remove features without liability, subject to applicable law.
We are not responsible for temporary interruptions, maintenance, technical issues, hosting outages, third-party service interruptions, payment processor issues, software bugs, data delays or search engine changes.

To the maximum extent permitted by law, Pilates.com.au is not liable for any indirect, incidental, special, consequential or economic loss, including loss of profit, loss of revenue, loss of business, loss of goodwill, loss of data, loss of opportunity, lost bookings, lost enquiries, lost sales or reputational damage.
To the maximum extent permitted by law, our total liability to you for claims arising out of or in connection with the Platform is limited to the amount paid by you to us in the 12 months before the claim arose, or the resupply of the relevant service, whichever is permitted by law.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under Australian Consumer Law.

You agree to indemnify us against any loss, damage, claim, liability, cost or expense arising from:
- your breach of these Terms;
- your misuse of the Platform;
- content you upload or publish;
- inaccurate or misleading listing information;
- unauthorised use of intellectual property;
- your sale or supply of goods or services;
- your dealings with buyers, sellers, members or users;
- your breach of privacy obligations;
- your breach of Australian Consumer Law or other applicable laws;
- your unauthorised listing claim;
- your false or misleading qualification, certification, health, clinical or product claims.
This indemnity does not apply to the extent the loss is caused by our own negligence, fraud, wilful misconduct or breach of law.

We may suspend, restrict, downgrade, remove or terminate your account, listing, membership, seller access, advertising placement or Platform access if we reasonably believe:
- you have breached these Terms;
- payment has failed;
- information provided is false, misleading or incomplete;
- you are misusing the Platform;
- your listing is inappropriate or unsafe;
- your conduct may harm users or the Platform;
- you have infringed intellectual property rights;
- you have breached privacy obligations;
- you have engaged in fraud, spam, scraping or unlawful activity;
- your account creates legal, security, reputational or operational risk.
You may stop using the Platform at any time.
Termination does not affect rights and obligations that accrued before termination, including payment obligations, intellectual property rights, disclaimers, limitations of liability, indemnities and dispute provisions.

If you have a complaint about Pilates.com.au, please contact us first so we can attempt to resolve the issue.
If you have a complaint about a third-party seller, studio, instructor, course provider, advertiser or service provider, you should contact that provider directly first.
We may, at our discretion, assist with communication or investigate possible misuse of the Platform. However, we are not required to resolve every dispute between users, buyers, sellers, members or third-party providers.
Nothing in this section limits your rights under Australian Consumer Law or any other applicable law.

We may update these Terms from time to time.
Where changes are material, we may notify users by email, account notice or a prominent notice on the Platform.
The updated Terms will apply from the date they are published or from any later date stated in the updated Terms.
Your continued use of the Platform after updated Terms are published means you accept the updated Terms.
If you do not agree to the updated Terms, you should stop using the Platform and cancel any relevant subscription.

These Terms are governed by the laws of New South Wales, Australia.
